By using the TurboCredito website for India (hereinafter referred to as the “Website”) and the services offered through it, you (hereinafter referred to as “you” or the “user”) agree to comply with these Terms and Conditions.

2. Purpose of the Website

The Website provides users with a free technology-enabled facilitation service that helps them access financing options offered by participating third parties, hereinafter referred to as “Lenders” or “Partners”. TurboCredito is not a bank, non-banking financial company, financial institution or lender, and does not itself grant or disburse loans.

TurboCredito acts as an intelligent platform that, based on the information provided by the user, collects and, where appropriate and subject to the required consent, transmits that information to third-party Lenders or Partners, or redirects the user to their respective channels, so that they may assess the user’s request and, where applicable, present a financing offer.

Information displayed on the Website: Any information, results or content displayed on the Website is provided for general informational purposes and may originate from third parties. It does not constitute financial advice or a personalised recommendation by TurboCredito.

• No guarantee of loan approval: TurboCredito does not guarantee the approval of any loan or financing request submitted through the Website. Approval, the amount offered, interest rate, repayment period, applicable charges and all other conditions will depend on the eligibility criteria, policies and credit assessment of the selected Lender.
• We are not responsible for agreements with Lenders: TurboCredito is not a party to any loan or financing agreement that you may enter into with a Lender through or following your use of the Website. Such agreements are governed by the relevant Lender’s own terms and conditions.

3. Eligibility and Conditions of Use

To use our services in India, you must be an Indian citizen or lawful resident of India and meet the following conditions:

• Minimum age: You must be at least 18 years of age.
• Legal capacity: You must have full legal capacity to enter into binding contracts under applicable Indian law.
• Accurate information: You must provide information that is accurate, complete and current at all times during the request or application process.

User responsibility: You agree to use the Website responsibly and not to provide false, inaccurate, incomplete or misleading information. TurboCredito will not be responsible for losses or other consequences arising from the incorrect or unauthorised use of the information provided.

5. Limitation of Liability

TurboCredito will not be responsible for:

• Accuracy of information provided by Lenders: We do not guarantee the truthfulness, accuracy, completeness or availability of information provided by Lenders on their websites, applications or other channels.
• Decisions based on the information: Any decision made by the user on the basis of information displayed on the Website is made at the user’s own discretion and responsibility.
• Operation of the Website: We do not guarantee that the Website will operate without interruption or be completely free from errors. Temporary interruptions may occur for technical, security, maintenance or other operational reasons.

Limitation of liability: To the maximum extent permitted by applicable law, TurboCredito will not be liable for any direct, indirect, special, incidental or consequential loss arising from the use of, or inability to use, the Website. This limitation does not apply to any liability or mandatory consumer right that cannot lawfully be excluded or limited.

10. Termination of the Service

TurboCredito may suspend or discontinue its services, or restrict or terminate your access to the Website, without prior notice where you breach these Terms and Conditions or where there is a reasonable suspicion of fraudulent, unlawful, abusive or unauthorised activity.

11. Governing Law and Jurisdiction

These Terms and Conditions will be governed by and interpreted in accordance with the laws applicable in India. Any dispute arising from or relating to these Terms and Conditions or the use of the Website will be subject to the jurisdiction of the competent courts, tribunals or statutory consumer dispute redressal commissions in India, without prejudice to any mandatory rights or remedies available to the user under applicable law.
